New Ohio Damages Cap Not to Apply to Catastrophic Injuries

Senate Bill 80 does not impose a cap on non-economic damages in cases involving catastrophic injuries.

The following injuries are considered catastrophic:
Permanent and substantial physical deformity
Loss of use of a limb, or loss of a bodily organ system
Permanent physical functional injury that permanently prevents the injured person from being able to independently care for self and perform life-sustaining activities
