Ohio Legislature Establishes Professional Liability "Safety Net"
Ohio House Bill 282, enacted into law in April 2004, established a state-operated coverage option in the event that Ohio's medical liability market totally collapses. The Medical Liability Underwriting Association (MLUA) is intended to function as a safety net and will start-up at the discretion of the Director of the Ohio Department of Insurance. In the event the MLUA becomes active, it is likely that the rates will be at or above the market rate.
Three of the five insurance companies currently providing professional liability insurance in Ohio are showing signs of financial problems according to the OSMA.
