Is Your Medical Records Release Form HIPAA Compliant?
Have you updated your medical release form to address HIPAA issues?
I recommend inserting the following language at the end of your release form:
This release is intended to comply with the Health Information Portability and Accountability Act (HIPAA).
In addition, it is very important that medical records only be released to authorized individuals. Your release form should have a space for a patient's representative to explain their relationship to the patient (i.e. legal guardian, attorney-in-fact, executor etc.) and your office policies should require that you ask the representative for a copy of the legal document authorizing such representation (i.e. appointment of guardianship from a probate court, durable power of attorney for health care, valid appointment of executor from a probate court, or other legally binding instrument).
